شروط وأحكام شركة سافكس

تحكم هذه الشروط والأحكام ("الشروط والأحكام") العلاقة القانونية بينكم (المشار إليكم فيما يلي بـ "أنتم") وشركة شركة سافكس للتجارة العامة والمقاولات  (المشار إليها فيما يلي بالتبادل بـ "نحن" أو "شركة سافكس "). وتشكل هذه الشروط والأحكام اتفاقية قانونية ملزمة بينكم وبين شركة سافكس.

إن شركة سافكس هي شركة لإدارة الفعاليات وهي متخصصة في تخطيط الفعاليات الرياضية وتنظيمها وتنفيذها. عندما تتسجلون للمشاركة في فعالية نظّمتها و/أو نظّمتها و/أو نفّذتها شركة سافكس ("فعالية ("فعاليات) شركة سافكس ") عبر موقع ويب شركة سافكس أو تطبيقها على الهاتف المحمول أو موقعها، فأنتم توافقون على هذه الشروط والأحكام، ويمثّل تسجيلكم للمشاركة في فعالية سافكس موافقتكم على هذه الشروط والأحكام وقبولكم بها. وفي حال لم توافقوا على هذه الشروط والأحكام، فلا يجوز لكم التسجيل للمشاركة في فعالية سافكس.

لذلك، يرجى قراءة هذه الشروط والأحكام بعناية قبل تسجيلكم للمشاركة في فعالية سافكس.

يجوز لشركة سافكس تعديل هذه الشروط والأحكام في أي وقت تختاره، ويبدأ تاريخ سريانها في التاريخ الذي يتم نشر هذه التعديلات على موقع ويب شركة سافكس أو تطبيقها على الهاتف المحمول أو موقعها. وتجدر الإشارة إلى أن الإبقاء على تسجيلكم في أي فعالية من فعاليات سافكس بعد نشر أي تعديلات يمثل موافقتكم على هذه التعديلات وقبولكم بها. وتقع على عاتقكم وحدكم مسؤولية التحقق من موقع شركة سافكس على الويب و / أو تطبيقها على الهاتف المحمول و / أو مواقعها، من وقت لآخر، للتأكد من إجراء أي تعديلات على هذه الشروط والأحكام.

قواعد التسجيل

عندما تتسجلون للمشاركة في فعالية سافكس ، يتعين عليكم الإفصاح عن معلومات معينة. يتعين عليكم التأكد من أن كافة المعلومات التي تفصحون عنها - كما هو مطلوب من قبل شركة سافكس - صحيحة ودقيقة وكاملة إلى أقصى حد ممكن ويتم تحديثها في حالة أي تغيير يطرأ على أي من المعلومات بعد تسجيلكم.

وإذا كنتم تتصرفون بالنيابة عن شخص آخر عند التسجيل للمشاركة في فعالية سافكس، فيتعين عليكم التأكد من أن الشخص الآخر: (1) يوافق على أن يتم تسجيله بواسطتكم للمشاركة في فعاليات سافكس؛ و (2) على علم بهذه الشروط والأحكام وموافقٌ عليها.

يجب الاحتفاظ بأي معلومات يتم الإفصاح عنها لشركة سافكس وحفظها وتخزينها ومعالجتها وجمعها بواسطة شركة سافكس و / أو مالك الفعالية و / أو أي طرف ثالث معين من قبل شركة سافكس.

يجوز أن تستخدم شركة سافكس معلومات الاتصال الخاصة بكم لإبقائكم على اطلاع دائم بما يلي: (1) آخر التطورات ذات الصلة بفعالية سافكس التي تسجّلتم للمشاركة فيها؛ و (2) فعاليات سافكس المستقبلية وآخر أخبار شركة سافكس.

إذا كان عمركم أقل من ثمانية عشر عامًا (18)، فيجب أن يسجّلكم أحد والديكم أو وصيكم القانوني نيابة عنكم للمشاركة في فعالية سافكس. 

للتسجيل والمشاركة في فعالية سافكس، فإنكم تفيدون وتقرون بما يلي: (1) أنكم بصحة جيدة؛ و (2) أنكم قادرون فعليًا على المشاركة في فعالية سافكس؛ و (3) أنتم على ثقة من أنه بإمكانكم خوض مراحل فعالية شركة بأن؛ و (4) أنكم على دراية بتدابير السلامة والطوارئ لفعالية سافكس. وإذا كان لديكم أي شك في أي من هذه الشروط، فيتعين عليكم الاتصال بممثل شركة سافكس الذي تم تعيينه في إطار لفعالية سافكس من أجل الحصول على مزيد من الإرشادات قبل التسجيل. وتحتفظ شركة سافكس بالحق في رفض تسجيلكم للمشاركة في فعالية سافكس إذا شك ممثلوها في استيفاء هذه الشروط.

إذا كنتم تشاركون في فعالية سافكس، فإنكم تقرون وتوافقون على أن شركة سافكس ستسجل فعالية سافكس عبر أجهزة الوسائط المتعددة الخاصة بها، بما في ذلك أن شركة سافكس يجوز أن تبث فعالية سافكس مباشرة على الهواء. وأنتم توافقون على أن تسجّل شركة سافكس فعالية سافكس وعلى أنه يجوز لشركة سافكس نشر و / أو إعادة نشر لقطات من فعالية سافكس عبر منصات شركة سافكس أو بالتعاون مع أطراف ثالثة تعينها شركة سافكس. تجدر الإشارة أن موافقتكم تشمل أنه يجوز لشركة سافكس نشر و / أو إعادة نشر ما يشبه سماتكم، كما هو مسجل في فعالية سافكس التي شاركتم فيها، فضلًا عن أنكم تتنازلون عن أي حقوق قد تكون لكم في هذه التسجيلات. 

قواعد فيروس كورونا المستجد:

نتيجة لجائحة كورونا، وامتثالاً لقرارات مجلس الوزراء الكويتي والتدابير الاحترازية للصحة والسلامة التي اقترحتها وزارة الصحة، فإنكم تفيدون وتقرون بأنكم: (1) لم تُصابوا بفيروس كورونا في غضون أربعة عشر يومًا قبل فعالية سافكس التي تسجلتم للمشاركة فيها؛ و (2) لم تكونوا على اتصال بأي شخص مصاب بفيروس كورونا في غضون أربعة عشر (14) يومًا قبل فعالية سافكس التي تسجلتم للمشاركة فيها؛ و (3) حصلتم على نتيجة اختبار PCR سلبية في غضون عشرة (10) أيام قبل فعالية سافكس التي تسجلتم للمشاركة فيها. 

للحفاظ على سلامتكم وسلامة المشاركين الآخرين و / أو الجمهور، يتعين على شركة سافكس رفض مشاركة أي مشارك في فعالية سافكس إذا ظهرت عليهم عوارض ارتفاع درجة الحرارة و / أو عوارض أخرى من عوارض فيروس كورونا.

إذا كنتم تعتقدون، خلال فعالية سافكس، أنه من غير الآمن لكم أو للآخرين مواصلة فعالية سافكس، فيتعين عليكم إبلاغ ممثل شركة سافكس في أقرب وقت ممكن بذلك. نتيجة لذلك، ستتخذ شركة سافكس كافة الاحتياطات والترتيبات اللازمة بشكل معقول لضمان سلامتكم وسلامة الآخرين.

بالنسبة إلى بعض فعاليات سافكس، ستنشر شركة سافكس قواعد وشروط محددة للمشاركة، ويجوز أن تتضمن هذه القواعد والشروط ملابس ومعدات معينة مطلوبة.  وأنتم توافقون على الالتزام بهذه القواعد والشروط المحددة بالإضافة إلى هذه الشروط والأحكام. على الرغم مما ورد أعلاه وما لم يُنص على خلاف ذلك، لا يُسمح لكم بإحضار أو استخدام في أي فعالية من فعاليات سافكس ما يلي: (1) الأجهزة ذات العجلات؛ و(2) ومعدات المساعدة الاصطناعية؛ و (3) الحيوانات؛ و (4) أي عناصر أو أجهزة أو أدوات أو معدات مساعدة أو غير ذلك - وفقًا لتقدير شركة سافكس وحدها - مما  يحول دون أو يجوز أن يحول دون سير فعالية سافكس و / أو يعرض سلامة المشاركين الآخرين في فعالية سافكس أو الجمهور للخطر.

تحتفظ شركة سافكس وحدها بالحق في طردكم من فعالية سافكس وإخراجكم من مقر فعالية سافكس، في الحالات التالية:

i.               إذا كنتم تشاركون، أو تحاولون المشاركة، بطريقة تعتقد شركة سافكس، وفقًا لتقديرها الخاص، أنها قد تسبب إصابة أو ضررًا أو تعرضكم للخطر، أو تعرض المشاركين الآخرين في فعالية سافكس أو الجمهور للخطر؛ و

ii.              إذا كنتم تستهلكون الكحول و / أو المخدرات قبل أو أثناء فعالية سافكس؛ و

iii.            إذا تأخرتم عن الموعد؛ و

iv.             إذا كنتم ترتدون رقم المشاركة الخاص بشخص آخر؛ و

v.              إذا كنتم تسمحون لشخص آخر بارتداء رقم المشاركة الخاص بكم؛ و

vi.             إذا كنت تستخدمون رقم مشاركة مزيف؛ و

vii.           إذا حاولتم بيع أو بعتم رقم مشاركتكم إلى شخص آخر؛ و

viii.          إذا قدّمتم معلومات خاطئة في تسجيلكم للمشاركة في فعالية سافكس؛ و

ix.             إذا كنتم تنتهكون أيًا من هذه الشروط والأحكام.

عند التسجيل للمشاركة في فعالية معينة من فعاليات سافكس، سيُطلب منكم دفع رسوم التسجيل ("رسوم التسجيل"). وتُعتبر رسوم التسجيل رسومًا مقابل خدمات شركة سافكس في ما يتعلق بالتخطيط لفعالية سافكس وتنظيمها وتنفيذها من أجلكم، وقد تغطي رسوم التسجيل أيضًا عناصر أخرى مثل أدوات المشاركة والخدمات المتنوعة الأخرى.

وفقًا لقانون حماية المستهلك (39/2014) وما لم تُلغِ شركة سافكس فعالية سافكس، تكون رسوم التسجيل غير قابلة للاسترداد في كافة الظروف. وفي حال ألغت شركة سافكس فعالية سافكس، فسيتم رد رسوم التسجيل إلى محفظتكم الافتراضية على حسابكم على موقع ويب شركة سافكس وتطبيقها عبر الهاتف المحمول. ويجوز لكم استخدام أي مبالغ في محفظتكم الافتراضية للتسجيل في فعاليات سافكس الأخرى.

إذا اخترتم خيار Upgraded Refundable Booking (الحجز مع قابلية استرداد الأموال الذي تمت ترقيته) أثناء التسجيل لفعالية سافكس، فيجوز لشركة سافكس رد رسوم التسجيل الخاصة بكم إلى محفظتكم الافتراضية إذا لم تتمكن من حضور فعالية سافكس لأحد الأسباب التالية فقط، مع مراعاة تقديمكم لإثبات لما يلي:                         
(1) المرض أو الإصابة؛ أو (2) حالة طبية قائمة مسبقًا؛ أو (3) مضاعفات الحمل؛ أو (4) وفاة أحد أفراد الأسرة المباشرين؛ أو (5) فشل في النقل العام أو (6) اضطرابات في الرحلة؛ أو (7) عطل ميكانيكي في وسيلة النقل الخاصة بكم؛ أو (8) سوء الأحوال الجوية؛ أو (9) حالة طوارئ في المنزل؛ أو (10) أي ظرف آخر تعتبره شركة سافكس مناسبًا لاسترداد الأموال وفقًا لتقديرها الخاص. لا يسمح اختياركم لخيار Upgraded Refundable Booking (الحجز مع قابلية استرداد الأموال الذي تمت ترقيته) باسترداد الأموال إذا كان سبب عدم حضوركم هو كما يلي: (1) يتعلق بشروط وقيود جائحة كورونا، باستثناء ما هو مذكور أدناه؛ (2) سبب تعرفونه أو كان من المعقول أن تعرفوه وقت التسجيل. ويجب أن يقتصر رد الأموال على رسوم التسجيل التي دفعتموها لفعالية سافكس فقط.

يجوز أن يتم استرداد رسوم التسجيل إذا اخترتم خيار Upgraded Refundable Booking (الحجز مع قابلية استرداد الأموال الذي تمت ترقيته) ونتج عدم حضوركم عما يلي (1) تمت إصابتكم أو إصابة أحد من أفراد أسرتكم، بفيروس كورونا في غضون أربعة عشر (14) قبل  فعالية سافكس؛ (2) دخل أحد أفراد أسرتكم المباشرين المستشفى و / أو توفي جراء فيروس كورونا في غضون ثمانية وعشرين (28) يومًا قبل فعالية سافكس؛ أو (3) حدث تغيير كبير في حالتكم الطبية القائمة مسبقًا في غضون أربعة عشر (14) يومًا قبل فعالية سافكس مما أدى إلى زيادة تعرضكم لعدوى و / أو عوارض فيروس كورونا.

إذا تم تأجيل فعالية سافكس التي تسجلتم للمشاركة فيها، فستقوم شركة سافكس بإعلامكم بمثل هذا التأجيل قبل شهر واحد على الأقل من التاريخ الجديد، ويتم تأجيل رسوم التسجيل لموعد فعالية سافكس المؤجلة.  وبالمثل، إذا تم دمج فعالية سافكس مع فعالية سافكس أخرى أو فعالية غير تابعة لشركة سافكس، فسيتم تأجيل رسوم التسجيل إلى موعد فعالية سافكس التي تم دمجها.

إذا واجهتم أي مشاكل في تسجيلكم للمشاركة في فعالية سافكس، مثل التسجيل المكرر، أو عدم استلامكم لبريد إلكتروني لتأكيد التسجيل أو الخصم غير الدقيق لأموالكم، فيتعين عليكم إخطار شركة سافكس على الفور بهذه المشكلة، وتقديم طلب استرداد عند الاقتضاء. وإذا وجدت شركة سافكس - وفقًا لتقديرها الخاص - أنكم مؤهلين لاسترداد أموالكم، فسيتم رد إلى محفظتكم الافتراضية أي مبالغ تم تحصيلها منكم.

يحتوي موقع ويب شركة سافكس وتطبيقها عبر الهاتف المحمول على محفظة افتراضية عند تسجيل حساب لدى شركة سافكس. بالتالي، يمكنكم إيداع الأموال في محفظتكم الافتراضية، واستخدام الأموال فيها للتسجيل في فعاليات سافكس. ولا يجوز لكم سحب أي أموال مودعة في المحفظة الافتراضية.

يتعين على فريق تجربة العملاء لدى شركة سافكس معالجة كافة طلبات الاسترداد. ولطلب استرداد، يتعين عليكم ملء وتقديم نموذج طلب استرداد الموجود على هذا الرابط: [https://www.refundable.me/extended/en/].

عند التسجيل لفعالية سافكس، قد تتلقى أغراض من شركة سافكس قبل تاريخ فعالية سافكس ("أغراض سافكس"). أنتم مسؤولون بشكل منفرد وكامل عن أغراض سافكس ويتعين عليكم الحرص على عدم فقدانها أو تلفها قبل تاريخ فعالية سافكس. ولن تمنحكم شركة سافكس  أي بديل عن أغراض سافكس المفقودة أو التالفة تحت أي ظرف من الظروف.

بالنسبة إلى بعض فعاليات سافكس، قد توفر شركة سافكس قمصان السباق للمشاركين، وهي متوفرة على أساس أسبقية الحضور.  لهذا السبب، لا نضمن لكم أن تحصلوا على قميص يناسب مقاسك قبل فعالية سافكس.

إذا قررت شركة سافكس منح الميداليات خلال فعالية سافكس، فلن يتم منح الميداليات إلا للمشاركين الذين أكملوا مراحل فعالية سافكس بما يرضي شركة سافكس. إذا تعذر عليكم إكمال مراحل فعالية سافكس أو تم استبعادكم من فعالية سافكس، فلن تحصل على هذه الميدالية.

بالنسبة إلى فعاليات معينة من فعاليات سافكس، قد توفر شركة سافكس إضافات مخصصة لأغراض سافكس. وللمطالبة بمثل هذه الإضافات، يتعين عليكم الالتزام بالقواعد والشروط المحددة ذات الصلة. تحتفظ شركة سافكس بالحق في التخلص من أي إضافات لأغراض سافكس إذا فشلتم في الالتزام بالقواعد والشروط المحددة ذات الصلة.  

بالنسبة إلى فعاليات معينة من فعاليات سافكس، يجوز أن تقدم شركة سافكس خدمات توصيل لأغراض سافكس إلى العنوان الذي تحددونه عند التسجيل للمشاركة في فعالية سافكس هذه. بالتالي، أنتم مسؤولون مسؤولية كاملة عن دقة واكتمال العنوان الذي تحددون للتوصيل، بما في ذلك إذا كن رقم (أرقام) الهاتف والبريد الإلكتروني المرتبط بالعنوان رقمًا قد التشغيل. قد تحدد شركة سافكس، أو جهة خارجية تعيّنها شركة سافكس لتسليم أغراض سافكس، إطارًا زمنيًا ونطاقًا زمنيًا معينين لعملية التوصيل التي ستُبلغكم بها شركة سافكس بمجرد علمها بها، حيث أنه ستكونون مسؤولين عن استلام أغراض سافكس أو تعينون شخصًا آخر ليستلمها عنكم. إذا لم يتم تسليم أغراض سافكس نتيجة خطأ في عنوانكم ورقم (أرقام) الهاتف والبريد الإلكتروني (البريد الإلكتروني) الخاص بكم و / أو عدم قدرتك على استلام أغراض سافكس، فستحتفظ شركة سافكس بأغراض سافكس من دون أي مسؤولية على الإطلاق على عاتق شركة سافكس.

بالنسبة إلى فعاليات معينة من فعاليات سافكس، يجوز أن تقدم شركة سافكس جوائز نقدية و / أو جوائز للفائز (الفائزين) و / أو المتسابقين في فعالية سافكس. إذا كنتم مؤهلين للحصول على جائزة أو جائزة نقدية، فأنتم مسؤولون عن دقة واكتمال المعلومات التي قدمتموها لشركة سافكس من أجل استلام الجائزة أو الجائزة النقدية المذكورة. فضلًا عن ذلك، ستقوم شركة سافكس بتحويل الجوائز النقدية إلى مشارك مؤهل فقط عن طريق التحويل المصرفي إلى الحساب الذي يجب أن يزودّ هذا الأخير شركة سافكس بمعلومات عنه. ولن يتم بأي حال من الأحوال تحويل جائزة نقدية إلى شخص آخر غير المشارك المؤهل.

لن تكون شركة سافكس مسؤولة عن أي أغراض مفقودة أو مسروقة في فعالية سافكس.

بالنسبة إلى بعض فعاليات سافكس، يجوز أن تفتح شركة سافكس متجرًا أو معرضًا لبيع منتجات معينة. وإذا قمتم بشراء أي أغراض من متجر أو معرض تابع لشركة سافكس، فأنتم مسؤولون عن الحجم والمنتج الذي تختارونه. ولا يجوز إرجاع أو استبدال المنتجات المباعة في متجر أو معرض تابع لشركة سافكس، وذلك لأسباب صحية.

لوائح فعاليات سافكس

في بعض من فعاليات سافكس، سيتم اتباع اللوائح التالية لتحديد ترتيب المشاركين:

i.               يتم تخصيص جهاز توقيت على شكل رقاقة يمكن التخلص منه ("جهاز التوقيت") لكل مشارك في فعالية سافكس المعنية التي يشارك فيها كل مشارك. وستقدم شركة سافكس إرشادات حول كيفية تشغيل جهاز التوقيت وتثبيته.

ii.              يرتدي المشارك جهاز التوقيت بشكل مرئي في كافة الأوقات طوال فترة فعالية سافكس لضمان دقة التوقيت.

iii.            يتم تحديد الوقت الرسمي الذي يستغرقه المشارك لإكمال مراحل فعالية سافكس بواسطة جهاز التوقيت بناءً على عبور المشارك لخط البداية وخط النهاية على التوالي.

iv.             إذا كان المشارك يرتدي أكثر من جهاز توقيت واحد، فسيتم استبعاد المشارك ولن يتم قيد سجل وقت المشارك.

v.              إذا كان المشارك يفتقد جهاز التوقيت أثناء عبور المشارك عبر نقاط التفتيش، فقد يتم استبعاد المشارك.

vi.             يجب أن يبدأ المشارك فعالية سافكس خلال وقت البدء المعترف به رسميًا من أجل تسجيل وقت الانتهاء الرسمي.

vii.           إذا كان المشارك يشك في الوقت الرسمي لمشارك آخر، فيتعين عليه إثارة هذه الشكوك لشركة سافكس عبر عنوان البريد الإلكتروني: [hi@wesuffix.com].

viii.          يقر المشارك بأن النتائج النهائية لفعالية سافكس تخضع للمراجعة النهائية ولقرار شركة سافكس.

ix.             في حال شارك المشارك من دون رقم رسمي أو جهاز توقيت، أو إذا كان جهاز التوقيت الخاص به يرتديه مشارك آخر، يتم عزل المشارك واستبعاده من فعالية سافكس.

تحتفظ شركة سافكس بالحق في حظركم نهائيًا من كافة فعاليات سافكس إذا تبين ما يلي: (1) أنكم تتلاعبون بكاميرات تتبع الوقت المثبتة في مقر فعالية سافكس؛ و (2) أنكم تبادلون رقم السباق المخصص لكم مع شخص آخر؛ و (3) أنكم تستخدمون أجهزة أو أدوات أو آلات غير مصرح بها في فعالية سافكس؛ و(4) أنكم تنخرطون في سلوك يخلو من الروح الرياضية وغير أخلاقي وغير محترم و / أو مسيء تجاه أشخاص آخرين، بما في ذلك المشاركين الآخرين وموظفي شركة سافكس والشركاء والمتطوعين والجمهور وغير ذلك؛ و (5) أنكم لا تحترمون أو تخالفون قواعد ولوائح شركة سافكس و / أو توجيهات أي مسؤولين معينين من قبل شركة سافكس لفعالية سافكس؛ و (6) أنكم تخالفون القانون و / أو النظام العام والآداب العامة.

يجوز لشركة سافكس أن تقوم أيضًا بتخطيط فعاليات سافكس الافتراضية وتنظيمها وتنفيذها. إذا قمتم بالتسجيل للمشاركة في فعالية سافكس افتراضية، فيتعين عليكم احترام قواعد ذلك والتنافس في فعالية سافكس الافتراضية بنزاهة. فضلًا عن ذلك، يتعين عليكم الامتناع عن الانخراط في أي سلوك احتيالي، بما في ذلك تقديم سجلات غير دقيقة أو غير صحيحة إلى شركة سافكس. ولن تكون شركة سافكس مسؤولة عن الاختلافات الناتجة عن اختلاف الأوقات المحسوبة بواسطة أجهزة توقيت مختلفة. 

استخدام موقع ويب شركة سافكس وتطبيقها على الهاتف المحمول

تمنحكم شركة سافكس ترخيصًا محدودًا وغير حصري وغير قابل للنقل وغير تجاري وقابل للإلغاء من أجل: (1) عرض موقع ويب شركة سافكس وتطبيقها على الهاتف المحمول والوصول إليهما واستخدامهما على جهازكم الشخصي؛ و (2) الحصول على أي من وكافة المحتويات والمعلومات القابلة للعرض واستخدامها لأغراضكم الشخصية. لا يجوز لكم استخدام موقع ويب شركة سافكس وتطبيقها على الهاتف المحمول إلا لاستخدامكم الشخصي. علاوة على ذلك، لا يجوز لكم استخدام أي وسيلة آلية أو مؤتمتة أو تتمتع بالذكاء الاصطناعي لاستخراج أي بيانات من موقع ويب شركة سافكس وتطبيق الهاتف المحمول الخاص بها. ولا يجوز أن ينتهك وصولكم واستخدامكم لموقع ويب شركة سافكس وتطبيقها على الهاتف المحمول أي حقوق ملكية مملوكة لشركة سافكس أو المحتوى القابل للعرض والمعلومات من قبل شركة سافكس أو أطراف ثالثة أخرى. بالإضافة إلى ذلك، لا يجوز لكم تغيير أو تعديل أو حذف أو إتلاف أي محتوى أو معلومات يتم عرضها على موقع ويب شركة سافكس وتطبيقها على الهاتف المحمول. إن أي حقوق غير ممنوحة صراحة بموجب هذا الترخيص محفوظة من قبل شركة سافكس.

إخلاء المسؤولية والإبراء والتعويض

يتم توفير فعاليات سافكس وموقع ويب شركة سافكس وتطبيقها على  الهاتف المحمول وأغراض سافكس وأي خدمات أخرى خاصة بشركة سافكس ("خدمات سافكس") "كما هي" و "بحسب توفرها". وتتنصل شركة سافكس من مسؤوليتها عن كافة الكفالات والضمانات غير المشار إليها صراحة في هذه الشروط والأحكام، سواء كانت صريحة أو ضمنية أو قانونية، بما في ذلك الضمان الضمني لقابلية التسويق، والضمان الضمني للملاءمة لغرض معين. ولا تقدم شركة سافكس أيضًا أي كفالة ذات صلة بالتوقيت أو الموثوقية أو الجودة أو توفر خدمات سافكس أو أي خدمات أو سلع أخرى تقدمها شركة سافكس، أو كفالة بأن تكون خدمات سافكس خالية من الأخطاء أو متواصلة. بالتالي، أنتم وحدكم مسؤولون عن مخاطر استخدام خدمات سافكس، إلى أقصى حد يسمح به القانون المعمول به. 

لن تكون شركة سافكس مسؤولة عن أي أضرار غير مباشرة أو عرضية أو خاصة أو عقابية أو تبعية، بما في ذلك خسارة في الأرباح أو فقدان البيانات أو الإصابة الشخصية أو تلف الممتلكات، تكون ذات صلة أو ناتجة عن استخدامكم لخدمات سافكس.

لن تكون شركة سافكس مسؤولة عن أي أضرار تنشأ عن اعتمادكم على خدمات سافكس، أو فيما يتعلق بالخسائر الناجمة عن معاملاتكم مع أطراف ثالثة بالاعتماد على خدمات سافكس.

بالتالي، يتعين عليكم تعويض شركة سافكس والشركات التابعة لها ومدرائها وموظفيها وحمايتها من أي من وكافة المطالبات والطلبات والخسائر والمسؤوليات والمصاريف، بما في ذلك أتعاب المحاماة، الناشئة عن أو ذات الصلة باستخدامكم لخدمات شركة سافكس، وخرقكم لهذه الشروط والأحكام أو خرقكم لحقوق أي طرف ثالث.

القانون المعمول به والمقر المعين

تُفسَّر هذه الشروط والأحكام وتخضع للقانون الكويتي فقط. في حال نشأ نزاع، يتعين عليكم أن تسعوا إلى حل النزاع وديًا مع شركة سافكس عن طريق الاتصال بشركة سافكس. إذا لم يتم حل النزاع وديًا، فستكون المحاكم الكويتية هي المكان الحصري والوحيد والمقر لأي تقاضي يتعلق بهذه الشروط والأحكام.

التنازلات

لا يجوز لكم التنازل عن هذه الشروط والأحكام إلى أي طرف ثالث من دون إذن خطي من شركة سافكس. يجوز لشركة سافكس التنازل عن هذه الشروط والأحكام من دون أذوناتكم إلى أي من الشركات التابعة لها أو الشركات الفرعية لها أو خلفائها عن طريق عمليات الاندماج أو الاستحواذ لعى حقوق ملكية  سافكس.

إذا قامت محكمة قضائية مختصة بإلغاء شرط في هذه الشروط والأحكام، فلن تتأثر بقية هذه الشروط والأحكام، ويجب استبدال الشروط الباطلة بشرط آخر يعكس نية الشرط الباطل.

Suffix Terms & Conditions

These Terms and Conditions (“Terms & Conditions”) govern the legal relationship between you (hereinafter referred to as “you”) and Suffix for General Trading and Contracting Company. (hereinafter referred to interchangeably as “us” or “SUFFIX”). These Terms & Conditions constitute a binding legal agreement between you and SUFFIX.

SUFFIX is an event management company specialized in planning, organizing and executing sporting events. By registering as an entrant to an event planned, organized and/or executed by SUFFIX (“SUFFIX Event(s)”) through a SUFFIX website, mobile application, or location, you are AGREEING to these Terms & Conditions, and your registration as an entrant in a SUFFIX Event represents your assent and acceptance of these Terms & Conditions. If you do not accept these Terms & Conditions, you may NOT register as an entrant in a SUFFIX Event.

Therefore, PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE REGISTERING AS AN ENTRANT TO A SUFFIX EVENT.

SUFFIX may amend these Terms & Conditions at any time of its choosing, the effective date of which shall be the date on which these amendments are posted on a SUFFIX website, mobile application or location. Your continued registration in any SUFFIX Event following the posting of any amendments represents your assent and acceptance of these amendments. It is your sole responsibility to check the SUFFIX website, mobile application and/or locations, from time to time, to ascertain whether any amendments to these Terms & Conditions have been made.

Registration Rules

When registering to a SUFFIX Event, you shall disclose certain information. You must ensure that all information disclosed by you – as required by SUFFIX – must be true, accurate, complete to the fullest extent possible and updated in the event any of the information changes after your registration.

If you are acting on behalf of another person when registering to a SUFFIX Event, you must ensure that the other person is: (i) consents and agrees to be registered by you to the SUFFIX Events; and (ii) aware of and agrees to These Terms & Conditions.

Any information disclosed to SUFFIX shall be kept, maintained, stored, processed and collected by SUFFIX, Event Owner and/or any third-party designated by SUFFIX.

SUFFIX may use your contact information to keep you updated with: (i) latest developments relating to the SUFFIX Event you have registered to; (ii) future SUFFIX Events and latest SUFFIX news.

If you are under the age of eighteen (18), you must be registered to a SUFFIX Event by your parent or legal guardian.

To register to, and participate in, a SUFFIX Event, you attest and acknowledge that: (i) you are of good health; (ii) you are physically able to participate in the SUFFIX Event; (iii) you are confident that you can complete the SUFFIX Event; and (iv) you are aware of the safety and emergency measures of the SUFFIX Event. If you are in doubt of any of these conditions, you shall contact a SUFFIX representative designated for the SUFFIX Event for further instructions before registering. SUFFIX reserves the right to refuse your registration to the SUFFIX Event if its representatives doubt your fulfillment of these conditions.

o   If you participate in a SUFFIX Event, you acknowledge and agree that SUFFIX will record the SUFFIX Event via its multiple media devices, including that SUFFIX may broadcast the SUFFIX Event live. You consent to SUFFIX’s recording of the SUFFIX Event and SUFFIX’s ability to publish and/or republish footage of the SUFFIX Event on SUFFIX’s platforms or with third-parties designated by SUFFIX. Your consent shall encompass SUFFIX’s ability to publish and/or republish your likeness as recorded in the SUFFIX Event you participated in. You also disclaim any rights you may have in such records.

COVID-19 Rules:

As a result of the COVID-19 pandemic and in compliance with the resolutions of the Kuwaiti Council of Ministers and health and safety precautionary measures suggested by the Ministry of Health, you attest and acknowledge that: (i) you have not been infected with COVID-19 within fourteen days before the SUFFIX Event you registered to; (ii) you have not been in contact with any person infected with COVID-19 within fourteen (14) days before the SUFFIX Event you registered to; and (iii) you have obtained a negative PCR test result within ten (10) days before the SUFFIX Event you registered to. 

To maintain your safety and the safety of other participants and/or the audience, SUFFIX shall decline the participation of any participant in a SUFFIX Event if they display signs of high temperature and/or other COVID-19 symptoms.

If, during a SUFFIX Event, you believe that it is unsafe for you or others to continue the SUFFIX Event, you shall inform a SUFFIX representative as soon as possible. SUFFIX will take all reasonably necessary precautions and arrangements to ensure your safety and the safety of others.

For some SUFFIX Events, SUFFIX will post specific rules and conditions of participation. These rules and conditions may include certain required dresswear and gear. You agree to adhere to these specific rules and conditions in addition to these Terms & Conditions. Notwithstanding the above and unless otherwise stated, you are not permitted to bring or use in any SUFFIX Event the following: (i) wheeled devices; (ii) artificial aids; (iii) animals; and (iv) any items, devices, gadgets, aids, tools or otherwise that – in SUFFIX’s sole discretion – may or can inhibit the flow of the SUFFIX Event and/or jeopardize the safety of, or cause danger to you, other participants in the SUFFIX Event or the audience.

SUFFIX reserves the sole right to dismiss you from the SUFFIX Event and have you removed from the premises of the SUFFIX Event if you:

x.              participate, or attempt to participate, in a manner that SUFFIX, in its sole discretion, believes may cause injury, damage or endanger you, other participants in the SUFFIX Event or the audience;

xi.             consumed or used alcohol and/or drugs before or during the SUFFIX Event;

xii.           are late;

xiii.          wearing another person’s participation number;

xiv.          allow another person to wear your participation number;

xv.           using a counterfeit participation number;

xvi.          attempted to sell or sold your participation number to another person;

xvii.        submitted false information in your registration to the SUFFIX Event; and

xviii.       violate any of these Terms & Conditions.

When you register to a particular SUFFIX Event, you will be asked to pay a registration fee (“Registration Fee”). The Registration Fee is in consideration for SUFFIX’s services in planning, organizing, and executing the SUFFIX Event for you, and the Registration Fee may also cover other items such as the participation kit, and other miscellaneous services.

Subject to the Consumer Protection Law (39/2014) and unless SUFFIX cancels the SUFFIX Event, the Registration Fee shall be non-refundable in all circumstances. If the SUFFIX cancels the SUFFIX Event, the Registration Fee will be refunded to your virtual wallet on your account on the SUFFIX website and mobile application. You may use any amounts in your virtual wallet to register for other SUFFIX Events.

If you opt for the Upgraded Refundable Booking option during your registration for the SUFFIX Event, SUFFIX may refund your Registration Fee to your virtual wallet if you are unable to attend the SUFFIX Event for one of the following reasons only, subject to your submission of proof of such:
(i) illness or injury; (ii) preexisting medical condition; (iii) pregnancy complication; (iv) death of an immediate family member; (v) public transportation failure; (vi) flight disruption; (vii) mechanical breakdown of your mode of transportation; (viii) adverse weather condition; (ix) home emergency; or (x) any other circumstance SUFFIX deems appropriate for a refund at its sole discretion. Your choice of the Upgraded Refundable Booking option does not allow you a refund if the reason for your non-attendance is: (i) related to COVID-19 conditions and restrictions except as otherwise indicated below; (ii) a reason you knew or reasonably should have know at the time of your registration. The refund shall be limited to only the Registration Fee you paid for the SUFFIX Event.

You may be refunded the Registration Fee if you have opted for the Upgraded Refundable Booking option and you non-attendance is because: (i) you, or a member of your household, was infected with COVID-19 within fourteen (14) before the SUFFIX Event; (ii) the hospitalization and/or death of your immediate family member due to Covid-19 within twenty-eight (28) days before the SUFFIX Event; or (iii) a significant change to your pre-existing medical conditions within fourteen (14) days before the SUFFIX Event resulting in your increased vulnerability to COVID-19 infection and/or symptoms.

If the SUFFIX Event you registered to is postponed, SUFFIX will notify you of such postponement at least one month in advance of the new date. The Registration Fee shall be deferred to the postponed SUFFIX Event. Similarly, if the SUFFIX Event is merged with another SUFFIX Event or non-SUFFIX Event, the Registration Fee shall be deferred to the merged SUFFIX Event.

If you face any problems with your registration for a SUFFIX Event, such as duplicate registration, your non-receipt of a confirmation email for your registration or wrongful deduction of money, you must immediately notify SUFFIX of such problem, and submit a refund request where applicable. If SUFFIX finds – in its sole discretion – that you are eligible for a refund, your virtual wallet will be refunded for any amounts that have been charged to you.

The SUFFIX website and mobile application contains a virtual wallet when you register an account with SUFFIX. You may deposit money into your virtual wallet, and use funds therein to register for SUFFIX Events. You may not withdraw any funds deposited into the virtual wallet.

SUFFIX’s Customer Experience Team shall handle all refund requests. To request a refund, you must fill and submit a Refund Application Form found here: [https://www.refundable.me/extended/en/].

When you register for a SUFFIX Event, you may receive SUFFIX items before the date of the SUFFIX Event (“SUFFIX Items”). You are solely and fully responsible for the SUFFIX Items and you must ensure that they are neither lost nor damaged before the date of the SUFFIX Event. SUFFIX shall not replace any lost or damaged SUFFIX Items under any circumstance.

For certain SUFFIX Events, SUFFIX may provide race t-shirts for the participants. Race t-shirts are available on a first-come, first-serve basis. You are therefore not guaranteed a t-shirt fitting your size before the SUFFIX Event.

If SUFFIX decides to award medals during the SUFFIX Event, the medals shall only be awarded to participants who complete the SUFFIX Event to the satisfaction of SUFFIX. If you do not complete the SUFFIX Event or are disqualified from the SUFFIX Event, you shall not receive such medal.

For certain SUFFIX Events, SUFFIX may provide customized add-ons to the SUFFIX Items. To claim such add-ons, you must adhere to the specific rules and conditions relating to such. SUFFIX reserves the right to dispose of any add-ons to the SUFFIX Items should you either fail to adhere to the specific rules and conditions related thereto.  

For certain SUFFIX Events, SUFFIX may offer delivery services of the SUFFIX Items to an address you designate when you register for that SUFFIX Event. You are fully responsible for the accuracy and completeness of the address you designate for delivery, including the operability of the phone number(s) and email(s) associated with the address. SUFFIX, or a third party designated by SUFFIX to deliver the SUFFIX Items, may specify a certain timeframe and date range for delivery which SUFFIX will communicate to you once known, to which you are responsible to, or have another person, be present to accept delivery of the SUFFIX Items. If the SUFFIX Items are not delivered because of an error in your address, phone number(s), email(s) and/or you unavailability to accept the SUFFIX Items, the SUFFIX Items shall be retained by SUFFIX at no responsibility whatsoever to SUFFIX.

For certain SUFFIX Events, SUFFIX may offer cash prizes and/or awards for the winner(s) and/or runner-offs of the SUFFIX Event. If you are eligible to a cash prize or award, you are responsible for the accuracy and completeness of the information you provided SUFFIX to receive said cash prize or award. SUFFIX will transfer cash prizes to an eligible participant only via bank transfer; which shall be provided by the eligible participant to SUFFIX. At no circumstance whatsoever will a cash prize be transferred to a person other than eligible participant.

SUFFIX shall not be responsible for any items lost or stolen at a SUFFIX Event.

For certain SUFFIX Events, SUFFIX may open a store or exhibit to sell certain products. If you purchase any items at a SUFFIX store or exhibit, you are responsible for the size and product you choose. Products sold at a SUFFIX store or exhibit are not returnable or exchangeable for health reasons.

SUFFIX Events Regulations

In certain SUFFIX Events, the following regulations will be followed to determine the participants’ standings:

x.              Each participant shall be assigned a disposable chip timing device (“Timing Device”) for the respective SUFFIX Event such participant is participating in. SUFFIX will provide instructions on how to operate and install the Timing Device.

xi.             The Timing Device shall, at all times, be visibly worn by the participant throughout the period of the SUFFIX Event to ensure accurate timing.

xii.           The official time taken by the participant to complete the SUFFIX Event shall be determined by the Timing Device based on the participant’s crossing of the starting line and the finish line respectively.

xiii.          If the participant is wearing more than one timing device, the participant will be disqualified and the participant’s time record shall not be recorded.

xiv.          If the participant is missing the Timing Device during the participant’s crossing through checkpoints, the participant may be disqualified.

xv.           The participant must begin the SUFFIX Event during the officially recognized starting time in order to register an official course completion time.

xvi.          If the participant doubts the official time of another participant, the participant must raise such doubts with SUFFIX via email: [hi@wesuffix.com].

xvii.        The participant acknowledges that the final results of a SUFFIX Event is subject to the final review and decision of SUFFIX.

xviii.       Participation without an official number or Timing Device, or if the Timing Device is worn by another participant, the participant shall be removed and disqualified from the SUFFIX Event.

SUFFIX reserves the right to ban you permanently from all SUFFIX Events if you are found to have been: (i) manipulating the time-tracking cameras installed on the SUFFIX Event premises; (ii) exchanging your assigned race number with another person; (iii) using unauthorized devices, tools or machines in the SUFFIX Event; (iv) engaging in unsportsmanlike, unethical, disrespectful and/or offensive behavior towards other persons, including other participants, SUFFIX staff, partners, volunteers, audience and otherwise; (v) disrespecting or disobeying SUFFIX’s rules and regulations and/or the directives of any officials designated by SUFFIX for the SUFFIX Event; and (vi) violating the law and/or public order and morals.

SUFFIX may also plan, organize and execute virtual SUFFIX Events. If you register to a virtual SUFFIX Event, you shall respect the rules thereof and compete in the virtual SUFFIX Event with integrity. You shall refrain from engaging in any fraudulent behavior, including the submission of inaccurate or untruthful records to SUFFIX. SUFFIX shall not be liable for discrepancies resulting from the differing times calculated by different timing devices. 

Use of SUFFIX Website and Mobile Application

SUFFIX grants you a limited, non-exclusive non-transferable, non-commercial and revocable license to: (i) view, access and use the SUFFIX website and mobile application on your personal device; and (ii) access and use of any and all viewable content and information for your personal use. You may only use the SUFFIX website and mobile application for your own personal use. You shall not use any automated, robotic or artificially intelligent means to extract any data from SUFFIX website and mobile application. Your access and use of the SUFFIX website and mobile application may not violate any proprietary rights owned by SUFFIX or the viewable content and information by either SUFFIX or other third parties. You may not alter, modify, change, delete or destroy any content and information viewed on SUFFIX website and mobile application. Any rights not expressly granted under this license are reserved by SUFFIX.

DISCLAIMER, RELEASE & INDEMNITY

The SUFFIX Events, the SUFFIX website and mobile application, the SUFFIX Items and any other SUFFIX services (the “SUFFIX Services”) are provided “as is” and “as available”. SUFFIX disclaims all representations and warranties which are not expressly indicated in these Terms & Conditions, whether express, implied or statutory, including the implied warranty of merchantability, implied warranty of fitness for a particular purpose. SUFFIX further makes no representation with respect to the timeliness, reliability, quality, or availability of the SUFFIX Services, or any other services or goods provided by SUFFIX, or that the SUFFIX Services shall be error-free or uninterrupted. The risk of using SUFFIX Services shall, to the maximum extent permitted under applicable law, remain with you. 

SUFFIX shall not be liable for any indirect, incidental, special, punitive or consequential damages including lost profit, lost data, personal injury, or property damage, related to or as a result of your use of the SUFFIX Services.

SUFFIX shall not be liable for any damages arising out of your reliance on SUFFIX Services, or in connection to losses due to your transactions with third-parties in reliance on SUFFIX Services.

You indemnify and hold harmless SUFFIX, its affiliates, directors, and employees from any and all claims, demands, losses, liabilities, and expenses, including attorneys’ fees, arising out of or in connection to your use of SUFFIX Services, your breach of these Terms & Conditions or your breach of the rights of any third-parties.

Applicable Law & Designated Forum

These Terms & Conditions shall be construed and governed by Kuwaiti law only. In the event of a dispute, you shall seek to amicably resolve the dispute with SUFFIX by contacting SUFFIX. If the dispute is not resolved amicably, Kuwaiti courts shall be the exclusive and sole venue and forum for any litigation relating to these Terms & Conditions.

Assignments

You may not assign these Terms & Conditions to any third-party without SUFFIX’s written permission. SUFFIX may assign these Terms & Conditions without your permissions to any of its affiliates, subsidiaries, successors by merger or acquirers of SUFFIX equity.

If a court of law of competent jurisdiction renders void a term in these Terms & Conditions, the rest of these Terms & Conditions shall not be affected; and the void terms shall be replaced with another term shall effectuates the intent of the void term.
